The Religious Land Use and Institutionalized Persons Act (RLUIPA) is intended to protect houses of worship and prisoners from undue restrictions that impact the right of free exercise of religion, such as through imposition of land use regulations or rules that impinge upon prisoners’ religious practices. ICNY is a co-sponsoring organization on this stimulating case study discussion about a Bridgewater, NJ Muslim community’s struggles to establish a mosque. Al Falah Center in Bridgewater, NJ recently resolved litigation involving RLUIPA and other claims against the Township of Bridgewater. What can we learn from this case about religious freedom today, the protection of minority religions, and the role of the courts in that dialogue?
